Payment Terms & Conditions

- Payment Structure:  Unless otherwise agreed in writing, payments for all Stonescapes Garden Design & Landscaping projects are structured as follows:

• 50% deposit due upon confirmation of booking to secure your project start date and allow for the ordering of materials

• 25% stage payment due upon completion of all agreed preparation works

• 25% final balance due immediately upon completion of the project


  Payment schedules may vary depending on the size, scope, or nature of the project. Any variations will be clearly outlined within your unique project plan or written quotation.  


- Stage Payments & Delays:  Failure to make any agreed stage payment by the due date may result in:

• Temporary suspension of works

• Delays to the overall project timeline

• Stonescapes staff being reallocated to alternative projects  Stonescapes accepts no liability for delays caused by late or non-payment.  


- Additional Works:  Any works not explicitly detailed within your agreed project plan or quotation will be considered additional work and may incur an additional charge.

• All additional work will be discussed and agreed prior to commencement

• Any additional payment required must be paid in advance of the additional work being carried out 


- Material Price Fluctuations:  All quotations are based on material prices at the time of issue. In the event of significant supplier price increases beyond Stonescapes’ control, Stonescapes reserves the right to pass on reasonable additional costs. Any such increase will be discussed and agreed with the client prior to materials being ordered. 


- Weather & Unforeseen Conditions:  Landscaping works are subject to weather conditions and unforeseen site issues, including but not limited to poor ground conditions, drainage issues, hidden services, restricted access, or obstructions. Stonescapes shall not be held responsible for delays arising from these factors, and project timelines may be adjusted accordingly.  


- Client-Requested Changes:  Any changes requested by the client once works have commenced may impact the project cost and/or completion timescale. All changes will be agreed prior to being carried out, and any additional payment required must be paid in advance. 


- Materials Ownership:  All materials supplied by Stonescapes Garden Design & Landscaping remain the property of Stonescapes until full and final payment has been received. In the event of non-payment, Stonescapes reserves the right to remove materials from site where legally permissible.  


- Warranty, Workmanship & Manufacturer Guarantees:  Stonescapes Garden Design & Landscaping warrants that all workmanship will be carried out with reasonable skill and care, in accordance with industry standards, and using materials appropriate for their intended purpose.  


Workmanship Warranty

• All workmanship is covered by a 12-month warranty from the date of practical completion, unless otherwise stated in writing.

• This warranty applies solely to defects arising directly from poor workmanship by Stonescapes.  Manufacturer Warranties

• Where materials or products supplied carry a manufacturer’s warranty (including but not limited to paving, porcelain, composite decking, drainage products, lighting, or fixtures), those warranties apply in addition to Stonescapes’ workmanship warranty.

• Manufacturer warranties are subject to the manufacturer’s own terms, conditions, and maintenance requirements.

• Stonescapes’ responsibility is limited to facilitating warranty claims where reasonably required and does not extend to liability for manufacturer defects.  


Exclusions This warranty does not cover issues arising from:

• Fair wear and tear or natural ageing

• Natural movement or settlement of ground, paving, or structures

• Timber shrinkage, expansion, cracking, twisting, or warping

• Efflorescence, colour variation, or weathering

• Extreme weather, flooding, subsidence, or acts of nature

• Pre-existing ground conditions or underground services

• Misuse, neglect, or failure to maintain

• Alterations or interference by third parties

• Plant, turf, or lawn failure where aftercare instructions have not been followed  


- Remedial Works: Any remedial works covered under this warranty will be carried out within a reasonable timeframe at Stonescapes’ discretion. Consequential losses or indirect damages are excluded.  


- Payment Condition: This warranty is valid only once full and final payment has been received.  


- Care & Maintenance : The client is responsible for the ongoing care and maintenance of all installed works following completion. Stonescapes will provide guidance or aftercare advice where applicable. Failure to follow recommended care and maintenance instructions may invalidate warranties or guarantees.  Non-Payment & Recovery  In the event of non-payment, Stonescapes reserves the right to take recovery action, which may include:

• Issuing formal payment demands

• Obtaining a County Court Judgment (CCJ)

• Pursuing court enforcement where necessary,  All reasonable costs incurred in recovering outstanding sums may be added to the balance owed.
