- Photography & Videography: Stonescapes Garden Design & Landscaping reserves the right to photograph and record video of projects before, during, and after completion for legitimate business purposes, including portfolio use, website content, social media, advertising, and promotional materials. All media will be taken with reasonable consideration for client privacy. Identifying features will not be intentionally included unless agreed in writing.
- Client Consent: By accepting a quotation, project plan, or entering into a contract with Stonescapes, the client grants irrevocable permission for Stonescapes to use photographs and videos of the works for marketing and promotional purposes. Any request to withhold consent must be made in writing prior to commencement of works. Requests made after works have started may not be accepted.
- Ownership of Media: All photographs, videos, drawings, plans, renders, visuals, and other media created by Stonescapes remain the exclusive intellectual property of Stonescapes Garden Design & Landscaping, unless otherwise agreed in writing. Clients are permitted to use images of their completed project for personal, non-commercial use only. Commercial use, reproduction, resale, or publication without written consent is prohibited.
- Design Concepts & Intellectual Property: All design concepts, layouts, drawings, specifications, visuals, and ideas produced by Stonescapes — whether paid for, partially paid for, accepted, rejected, or unused — remain the intellectual property of Stonescapes.
• Designs may not be copied, reproduced, adapted, shared, or issued to third parties
• Designs may not be used to obtain alternative quotations or be constructed by others
• Unauthorised use of Stonescapes’ designs may result in recovery action for design fees, loss of earnings, and associated costs
Ownership of design rights will transfer only where explicitly agreed in writing and, where applicable, subject to an additional design release fee. Third-Party Use No third party, including other contractors, suppliers, or developers, may use Stonescapes’ images, videos, or designs without prior written permission.
- Removal of Media: Stonescapes will consider reasonable requests to remove published images from future use. However, removal cannot be guaranteed where content has already been published, printed, indexed, or shared by third parties.
